2. Transport Direct
"Transport Direct" means the Secretary of State for Transport acting through the Transport Direct division of the Department for Transport which aims to provide through the Transport Direct Portal located at www.TransportDirect.info (hereafter the "Website"), a travel information and journey planning service for the UK. 3. Copyright
3.1 Subject to Clause 4 below, all text, data, charts, tables, software, video, music, sound, graphics, photographs, illustrations, artwork, names, logos, and all other material of whatever nature contained on the Website and all copyright which may subsist in this Website (together, the "Content") belongs to and shall remain at all times the property of Transport Direct or a third party owner. You are only authorised to make up to a maximum of ten (10) copies of the results of a map or route search for your own personal, non-commercial use.

5. Other Intellectual Property Rights
The trade marks, service marks and logos used and displayed on this Website ("Trade Marks") are registered or unregistered trade marks of Transport Direct or a third party. Nothing on this Website should be construed as granting, by implication or otherwise, any licence or right to use any Trade Mark without written permission from Transport Direct or the third party owner. The name of Transport Direct or the third party owner may not be used in any way, including in advertising or publicity pertaining to distribution of Content without the prior written permission of Transport Direct or third party owner as appropriate.
6. Unlawful Use
6.1 You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of the Website by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is defamatory, or which may harass, cause distress, cause offence or inconvenience to any person and the transmission of obscene or offensive content or the disruption of normal flow of dialogue within the Website.

7.1 The Website and Content is provided "AS IS" and on an "AS AVAILABLE" basis and neither Transport Direct nor its suppliers of third party data referred to in clause 7.2 below guarantee the accuracy, timeliness, completeness, performance or fitness for a particular purpose of the Website or any Content whatsoever. All implied warranties, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy are excluded from these Terms to the extent that they may be excluded as a matter of law.
7.2 Transport Direct uses information derived from third party data. Neither Transport Direct nor the suppliers of third party data warrant the accuracy of the data and accept no liability of any kind to any person in relation to the data including liability for errors or defects in or omissions from the data, delays in publication of the data or any breakdown or cessation of the journey planning service or (in the case of Transport Direct) the supply of data from its third party contractors howsoever caused. This limitation of liability includes without limitation liability with respect to any transaction entered into between you and a ticket retailer that you access by using this Website.
7.3 In no event will Transport Direct or its suppliers of third party data be liable for any loss including, without limitation, indirect or consequential loss, or any damages arising from loss of use, data or profits, whether in contract, tort or otherwise, arising out of or in connection with the use of this Website, or any transaction entered into between you and a ticket retailer that you access by using this Website.
7.4 The Content is provided on an information basis only and should not be relied upon. Where the timing of a journey is of particular importance to you, we advise you to check the information before you travel with the transport operator directly. No responsibility is accepted by or on behalf of Transport Direct or its suppliers of third party data for any errors, omissions, or misleading Content on the Website or on any websites to which the Website connects.
7.5 Neither Transport Direct nor its suppliers of third party data warrant that the Website or Content will be uninterrupted or error free, that any defects will be corrected, or that this Website or the server that makes it available are free of viruses or bugs.
7.6 Without prejudice to the other provisions of this Clause 7, Transport Direct may at its absolute and sole discretion offer compensation to users who it believes have a valid claim for loss suffered as a result of reliance on information on the Website which was inaccurate. If you wish to apply for such compensation you must contact us using the feedback form. Please click on the ‘I found incorrect information for’ radio button, specifying the mode for which the incorrect information was given and then writing CLAIM FORM in the ‘Details’ box. Please also include your name and full postal address in the ‘Details’ box.
Please be aware that submitting feedback through the Portal generates an automatic acknowledgement if you have entered your email address. Although this acknowledgement will serve as confirmation that we have received your request for a claim form, the actual wording in that message will not appear to be appropriate to your request for a claim form and should be disregarded.
Please note that we will not be able to pay compensation in cases where the journey offered is substantially correct but not necessarily the optimal solution for your requirements, especially where a number of different solutions are possible. Nor will we pay compensation where you have placed unreasonable reliance on information that is obviously incorrect, or where you were reasonably able to alter your journey on the day of travel.
7.7 For air journeys the specific times we list are not plane arrival or departure times. "Leave" is the latest time that we recommend you reach the "Check-in desk" and "Arrive" is the time we estimate you will be able to exit the airport after you land and collect your luggage. However, check-in times vary between airlines and you should check with the individual airline before travelling.
8. Privacy
You must read and accept the Transport Direct Privacy policy which details what type of personal information Transport Direct may collect from you when you visit the Website and how Transport Direct may store and use the information in accordance with the Data Protection Act 1998.
9. Changes to the Terms
Transport Direct reserves the right, at its discretion, to make changes to any parts of the Website or these Terms. When these Terms are amended, Transport Direct will publish details of the amendments on the Website. Your continued use of the Website is taken as your agreement to be bound by these Terms as amended.
10. Jurisdiction
These Terms shall be governed by and construed in accordance with English Law and subject to the exclusive jurisdiction of the English Courts.
11. Severability
If these Terms or any part of them should be determined to be illegal, invalid or otherwise unenforceable under the laws of any state or country in which these Terms are intended to be effective, then to the extent that they are so illegal, invalid or unenforceable, they shall in that state or country be treated as severed and deleted from these Terms and the remaining Terms shall survive and remain in full force and effect and continue to be binding and enforceable in that state or country.
12. Events beyond our control
Transport Direct will not be responsible for any breach of these Terms caused by circumstances beyond its reasonable control.

13.1 Transport Direct is not responsible for the availability or content of any third party websites or material you access through this Website. Transport Direct reasonably believes that websites accessible by hypertext link from the Website are reputable and accurate BUT Transport Direct does not endorse the views expressed within such websites and linking should not be taken as an endorsement by Transport Direct of any such third party website.
13.2 Transport Direct encourages users to establish hypertext links to the homepage of this Website. However, Transport Direct does not permit the use of its trademarks, service marks or logos without prior written permission.
